Mississippi Longshore Workers: Are You Injured and Confused?

Now, back to the matter at hand. The LHWC protects waterfront workers like you. But here’s the catch: your injury needs to happen under specific circumstances to qualify. That means understanding two key things: “situs” (where the accident occurred) and “status” (the nature of your work).

Understanding Mississippi longshore injury situs and status requirements is crucial for determining whether you qualify for benefits under the Longshore and Harbor Workers’ Compensation Act (LHWC).

Think of it like this: the LHWC is a life raft, but it only works on specific parts of the ocean. Let’s break it down:

Situs: The injury must occur on the navigable waters of the United States. This includes dry docks where vessels are repaired. There’s also a landward area covered by the Act, but we’ll get to that in a minute.
Status: Your work duties must be maritime in nature and not specifically excluded by the Act. Think loading and unloading cargo, ship repair, or operating cranes.

Here’s the legal mumbo-jumbo and I’ll explain it in English later in this post:

If you have a Mississippi Lonshore injury, you must show that the injury occurred upon the navigable waters of the United States, including any dry dock, or that it occurred on a landward area covered by Section 3(a), and that the employee’s work is maritime in nature and is not specifically excluded by the Act. 33 U.S.C. §§902(3), 903(a); Director, OWCP v. Perini North River Associates, 459 U.S. 297, 15 BRBS 62(CRT) (1983); P.C. Pfeiffer Co. v. Ford, 444 U.S. 69, 11 BRBS 320 (1979); Northeast Marine Terminal Co. v. Caputo, 432 U.S. 249, 6 BRBS 150 (1977).

Thus, in order to demonstrate that coverage under the Act exists, a claimant must satisfy the “situs” and the “status” requirements of the Act. See also Crapanzano v. Rice Mohawk, U.S. Constr. Co., Ltd., 30 BRBS 81 (1996).

In other words, as an injured worker, you must show where the accident occurred and that your employer’s work is maritime in nature.
